Pls. advice if taking my Motorcycle Plate Number is correct when my license don’t show # 1 resitriction-> w/c is for me to be able to drive motorcycle. The MMDA officer said that I don’t have a license that’s why he took my Plate Number. Is this correct? Pls. advice how much I’ll pay to the Municipal Hall of Paranaque.

As far as i know, bawal na ang magkuha ng plate number ngayon gaya ng sa kotse. Yung sa kaso mo bro, considered na driving w/o license yan talaga. baka naman ginawa nila itong move na ganito instead of impounding your bike, not so sure. I think the penalty is P750.
Bro I don’t know about the plate but bro ching is correct driving without license yan kaso mo. Pero I think not unless na may batas na magsasabi na puwede ang pagkuha ng plate number, it’s still unjust & illegal to just get your PN without any explaination.

I agree with the previous comments. Taking your plate number is not the proper way to apprehend such violation. You should be cited with a driving without license violation and it will cost you pretty much around 750 pesos. Your license could be confiscated but not the plate. Kung ang violation mo lang ay walang restriction #1, 750 pesos yun.

this is very enlightening, as i once had restrctions 1& 2 in my license, bt when i renewed it, i didnt notice na number 2 na lang pala ang restriction ko…this means i wont be able to drive na pala my bike. anyhow, should i wait for the renewal (which is on dec 2007 pa) or can i have it changed na agad sa LTO? please advise namn. thanks

Thanks a lot for your comment. Mahal pala ang Driving w/out restriction # 1 = 750 pesos! Pero pwede bang mag-renew (change of restriction)kahit di pa expire license? Kasi natatandaan kong pina-change ko na restriction minsan sa LTO Alabang sabi pag-expire nalang daw.

Actually you can have your license updated with your new restriction code anytime. But it is treated as a renewal. That happened to me when I got my RC 1, I had just renewed my license a few months back then got my RC 1 and had my license sort of re-renewed again. It’s a waste of money but you need the RC 1 to operate your MC so I’d say it’s money well spent.
Never drive your bike without a RC 1.

But the MMDA has still no basis to remove my Plate Number right? – No existing Procedure. Maybe he can charge me of my initial violation of “Disobedience to Traffic Light” & violation to restriction code and take my license, pero taking my Plate Number is not right. Pls. correct me if I’m wrong. Thanks.

TCT lang yan bro, 1st violation-Disobeying traffic signals P150., 2nd violation-Unauthorized use of vehicle not prescribed in stated RC P750. yun lang, wala na iba. yung sa plates, bawal yan. tubusin mo nalng bro para matapos na. But if you wish to retaliate, get his name then ireklamo. about sa RC, adding 1 to yours cost P100. pwede yan any time, di ako sure kung magkano total, kasi bago picture, bago card, bago OR. dala ka P1,200 punta mmda (900), yung tira, LTO agency m for the additional RC. O di legal na? Ok! Whew!, costly…. but it pays off.
bro i think dapat magtanong ka sa LTO, kasi before nung nagpalagay ako ng RC1 sabi nila pwede na rin daw kahit wala na, kagaya na rin nung sa mga automatic transmission, before kailang naka indicate yung RC ng mga automatic trans user pero ngayon under na sa RC2, saka ang alam ko walang proper trainings or even a single seminars ang mga MMDA sa LTO or hindi sila deputized kaya dapat nga hindi sila nangunguha ng DL or even kahit mag bakbak ng plate ay illegal, sa pag kakaalam ko LTO Deputized at mga DOTC lang ang authorized na manguha ng DL at Plate #….. to all MC Clubs or Groups better to ask Daisy Jacobo of LTO Regarding this matter…kasi during are trainings, seminar to be come deputized agent natatandaan ko na sinabi nya ang mga bagay na nasabi ko….
Bro, tingin ko hindi dapat kang mag-drive ng motorcycle na walang RC1 kasi yan talaga ang para sa MC. You can check the forums here may mga nagsasabi na may mga LTO offices na sandali lang daw mag-renew. Yesterday nagtatawag ako ng mga LTO kiosk .. pwede nga daw mag-renew sa kanila at wala pang 1 hour .. may card pa .. mainit-init pa. Sa Alabang Town Center meron .. sa Ayala MRT meron din .. sa Farmers Cubao meron din .. yun lang yung mga alam kong kiosks.
Pa-renew mo na lang kapag nakuha mo na plate mo.
Hello Guys, Thanks for your comment. Pinuntahan ko kanina sama asawa ko at sinabi mag-babayad daw kmi ng 1,000 pesos! They showed me I violated Article 97B (Violation of Restriction Code) equal to 1,000pesos! We contested it and we have a hearing tomorrow. Kasi sabi attorney di daw dapat kinuha Plate Number dapat license lang. I’ll inform you guys tomorrow on the outcome. Thanks a lot for your comment and suggestion.

male yung ginawa sayo bro di dapat binakbak yung plate mo, dapat tiket lang binigay sayo, kung sakale kaninuman na mangyare ang ganito wag din kayo pumayag na impound bike nyo dahel registered yan kahet na expire pa yung registration not unless involving accident ala sila karapatan na impound ang ride mo. it is good na contest mo kaya lang bro honestly ala din mangyayare bayad kapadin ng penalty tapos abala kapa, kala mo ba pakikinggan ka ng mga yan , hahayaan ka lang nila mag air ng reklamo mo pero in the end you will still be paying the penalty, saka yung sabe ng attorney mo na dapat liscense lang confiscate di rin pwede yun kase ang mmda penalty sa banko(metrobank) ang bayad. after your ordeal dumiretso kana sa lto padagdagan mo na ng restriction liscense mo, sorry you had to learn your lesson the hard way! ride safe bro!

as far as legality is concern, mali po yong ginawa ng MMDA Enforcer, he should only gave u a receipt of your violiation e.i. considered as driving w/o lincense. Ang pagkuha po ang iyong plate number ay paglabag sa karapatang pantao, kung ang iyong motorcycle po ay mapapatunayan na legal in papers. Dapat po ito, if you like, you can file a case agianst him.

Bro ganyan na talaga ngayon sa LTO ultimo driver without wearing a helmet plaka na ang kinukumpiska para yung motor mismo ang maparalize. and also LTO doesn’t have time to explain it kasi ituturo sayo lahat yan pagtubos mo ng PLAKA mo kasi mag se-seminar kapa bago mo makuha yang PLAKA mo. SEMINAR para matuto lahat na gaya nating mga driver na malaman lahat ng dapat malaman bago sumakay at magpatakabo ng sasakayan.Pero payo lang next time abatan nyo na sa loob bago pa ipasok sa taas para maka iwas kayo sa seminar, hehehehehe.
Sorry misunderstood kala ko kasi LTO nakahuli sayo. yung nasabi ko batas ng LTO hindi ko lang alam kung ganyan din sa MMDA. pero malamang may semilarity sila kaya next time bro magpalagay ka ng Restriction 1 sa license mo at always wearing helmet para makaiwas sa mga buwaya.

hi guys. nobody, not the LTO nor the MMDA has the authority to confiscate license plates for traffic violations. in fact, the court of appeals sometime last year has ruled that even for parking violations, they cannot confiscate license plates.
“Court records showed that Garcia, driving his vehicle, accompanied his friends to the Ninoy Aquino International Airport (NAIA).
Upon reaching the NAIA, Garcia stopped his car in one of the vacant slots for unloading passengers and luggage and helped his friends carry their luggage to the Canadian Airlines counter.
When he returned to his car, he found out that Poblete had already detached its front license plate and a TOP was clipped to the windshield wiper.
Garcia then introduced himself as the owner and inquired why Poblete detached his license plate.
Poblete told Garcia that somebody had complained that Garcia’s vehicle caused traffic obstruction, but Garcia told him that it couldn’t be possible since the car was parked in a vacant space intended for unloading passengers and their luggage and neither could it be said that the car was left unattended because he had only been away for a few minutes.
Garcia filed a complaint for injunctive relief and damages against Calima and Poblete, saying the confiscation of his license plate was illegal since he did not violate any NAIA traffic regulation and that R.A. 4136 or the Land Transportation and Traffic Code does not empower the LTO to confiscate license plates.
The Quezon City RTC ordered the LTO or any of its authorized representatives or deputies to release the license plate of Garcia’s vehicle, and reinstall it.
The Court of Appeals upheld the Decision of the RTC.”

bro. ang pagkakaalam ko dyan ay hindi na puedeng kunin ang plaka, titikitan ka na lang at tutubusin mo doon sa malapit na munisipyo sa pinaghulihan mo. Regarding sa code ay kailangan mo talaga ng RC#1 puede mong papalitan ang license mo kahit hindi pa expire. Kasi ang code dati ay RC#2 lang, pinadagdagan ko ito ng RC#2,3 para wala na silang masabi. Sa mga pixer ka na lang magpalakad para wala ng seminar, hindi ka aabot ng worth 1,500

Actually I have the same problem that is hwy I cn’t enjoy the ride this summer My license has no RC-1 so wait pa ko till got renewed my license for add RC-1
ang hirap kasi dito sa bansa natin, iba-iba ang penalty bawat municipalities. tpos iba rin sa LTO, MMDA. kaya nakakalito. dapat isa lang talaga ang may hawak ng traffic satin. kung LTO, LTO lang. kung MMDA e MMDA lang. kasi my bro once was apprehended. Beating the red light sa alabang. Sa LTO, walang definite violation anf beating the red light. sa municipality level pinagbayad sya ng P500 ng kinuha nya yung license nya.

you cant be charge driving without license since you really have license. its just that you are lacking a restriction for driving a motorcycle. that will put you under
Violation 2.
which states….
Driving with a delinquent, invalid, suspended ineffectual of revoked license.
the officer should underline or take note of INVALID or INEFFECTUAL.
the sad parts is that not all of the deputized MMDA enforcer is that they dont really have an idea what to impose with all these fines and penalties when you have a violations.
Why would they take your license plate anyways? Unless your vehicle has some sort of deliquencies. But if your MC has complete and clean documents, its you who have a violation not your motor vehicle. I dont see any reason why would they confiscate your license plate
The violation of driving without a license is an “impoundable offense”. So the apprehending officer took your plate number instead of impounding your vehicle. Pwede yan because the taking the plate number is called “technical impounding”. You can get your plate number at the LTO office after paying the necessary fines.
last november 24, 2006, na carnapped yung motorcycle ko. Last july 06, 2007,mayroon akong pagdududa sa isang motorcycle na sinusundan ko, nakuha ko ang plate number nya, pwd ko ba mahanap sa web site kung sino ang may ari ng plate number ng motorcycle na nasundan ko. thanks
