Point of clarification on the August 2003 decision of the Supreme Court:

1. The decision revokes the DPWH order allowing access to 400cc bikes and upholds the original DPWH order to ban ALL motorcylces access to "limited access highways"
2. HOWEVER, the same decision also declares the DPWH order which categorizes the NLEX & SLEX as "limited access highways", as illegal; because by law it is only the DOTC that can declare whether the NLEX or SLEX is a "limited access highway".

Now, therefore, unless the DOTC has a written document showing the NLEX & SLEX as a "limtied access highway", the DPWH does not have authority to ban motorcycles on them.

Question: Is there already a DOTC document declaring NLEX & SLEX as "limited access highway"?

If No, then DPWH's ban on motorcyles has no legal basis and it will not stand legal ground if they bring anybody to court.

If So, then they have the legal basis to bring someone to court. In which case, the strategy of us motorcycle enthusiasts is to direct our lobbying to DOTC which is the policy making body (DPWH is just an implementing body).
