View Full Version : Help A Victim Of Reckless Indifference
FRANCIS CHING November 30th, 2003, 12:47 AM :angry: DEAR SIRS AND MADAMS OF THE ROAD;
GOOD DAY TO YOU ALL. PLEASE HELP ME FIND JUSTICE. LAST JANUARY I JOINED THE ILL- PREPARED PRESIDENTS RUN WHICH WAS SCHEDULED TO RIDE AROUND THE PHILIPPINES AND WAS SUPPOSED TO PROVIDE RIDERS WITH GAS, FOOD AND LODGING AND SOUVENEIRS. SAD TO SAY I GOT MORE THAN I BARGAINED FOR.
THE LAST MINUTE WITHDRAWAL OF FREEGAS I COULD UNDERSTAND. THE SLEEPING IN MOSQUITO INFESTED BASKETBALL GYMS I CAN ACCEPT. :{
BUT THE RECKLESS DUMPTRUCK WITH AN UNLICENSED DRIVER AND AN UNREGISTERED TRUCK BELONGING TO A CITY MAYOR WHO TOOK AWAY MY LEFT KNEECAP AND GAVE ME MAJOR HEAD SURGERY, I DEFINITELY COULD NOT ACCEPT!!!!!!!! :angry:
WE ARE PRESENTLY IN HEAVY DEBTS, COMING FROM A MIDDLE-CLASS FAMILY WHICH BARELY EKE OUT A LIVING.THE HOSPITAL BILLS WERE MONUMENTAL.
SO PLEASE..... HELP ME FIND JUSTICE. OR COMPENSATIONS. THE POLICE REPORTS AND DOCUMENTS AND VISUAL TAPES ARE IN ORDER.
YOU CAN CONTACT ME VIA E-MAIL AT REDCHINAZ@HOTMAIL . COM OR MY CELPHONE 0919 3083679
GODBLESS YOU, FRANCIS CHING
James Mirasol December 1st, 2003, 09:29 AM Francis,
Sorry to hear about your unfortunate accident.
If all your documents are in order, what's the problem?
Also, I imagine that your ride organizers and ride directors would be the right people to bring your concern to. Have you done this? If so, what was the action taken?
FRANCIS CHING December 2nd, 2003, 02:17 AM Dear Sir,
Your concerns has revived my spirits. Thank You ! After gaining conciousness i was aghast to know that nobody gave a **** to the matter. my family really have no idea what to do. the PAO in cityhall said it was not their jurisdiction. All i got from the organizers were " you signed a waiver....bla bla bla(my hands are off)"(kawawa ka naman). some RMF guys (Sir Noli,Sir Boysie,Mam Mylene )tried to help but (madaming Dedma).:* :{
Mr. Mirasol i'm at the end of my ropes. parang gusto ko nang manghiram ng baril. lahat ng pwedeng ibenta naka ads na. BILLS are piling up. maybe you guys can send me to someone who knows what to do.
Again Thank You Sir, May The Good Lord watch over your Loved Ones. and may your Gas Tank never run dry.
Francis
:) :)
Tom Mirasol December 2nd, 2003, 06:16 AM A few questions:
Do you have accident insurance to cover the bills?
Who is the Mayor who owns the truck? Shouldn't you be claiming from their insurance company? I am guessing that since the truck was unregistered it is also not insured. Have you tried yet?
Was a police report filed?
Perhaps we should send a message to the good mayor and give him an opportunity to do the right thing. :>
rommel December 2nd, 2003, 06:19 AM What happened was very sad Francis, were you riding with your friends or just joined in? Where did the accident occured? Can you give more details of the accident and tell us the story on how it happened?
Have you took this to court already and have somebody defend you?
CaMoTe!!! December 2nd, 2003, 07:59 AM what is it that you want to do francis?
bemps December 2nd, 2003, 01:17 PM Francis....... dont loose hope, There is always a better way to handle this, even if a certain Mayor is involved, there is a thousand ways to skin a cat, and it can be done legaly, and I think people here out of the many that read your post right now, is finding a way to do just that, please be paitient, there is always a better way.
James Mirasol December 2nd, 2003, 06:35 PM Francis,
Thanks for your kind words. As you can see, there are many good bikers and human beings that care about their fellow riders and fellow man.
As Tom, Rommel and Camote have pointed out, we need more information. Can you please provide all the details that you can about the incident. Leave nothing out.
I need to know who the organizers are, what was stated in this "waiver", what you know about the truck, the driver, the mayor. Where did this happen, exactly, what time, etc.
What did the police report indicate? Etc, etc.
FYI, even if you signed a waiver, you cannot sign away your rights. Ignorance of this fact is something that a lot of people who organize events hide behind. So don't just take that BS. It's quite possible that they are liable after all.
Anyhow, tell us EVERYTHING that you feel comfortable telling and perhaps we should arrange to meet so that we can see what can be done, bro. No promises or anything, other than we will help in any way that we can.
Stay cool, bro. You're aren't as alone as you think.
James
