Claiming self-defense, Regional Trial Court judge Francisco Querubin has apparently been able to persuade the victim's family to no longer pursue the case."
The motorist was a motorcycle rider.

Murder raps filed vs RTC judge

ANTIPOLO CITY — Formal charges of murder and illegal possession of firearms were filed yesterday at the prosecutor’s office against Judge Francisco Querubin of Antipolo City Regional Trial Court Branch 72.
The filing of charges came after the judge allegedly shot and killed Gerardo Martinez, former bodyguard of Antipolo City Mayor Angelito Gatbalayan last Friday night over a simple traffic incident.
Supt. Jose Dayco, city police chief, said the judge was charged with murder because the magnum .357 revolver he used in the shooting was a high-powered gun. The bullet that killed Martinez had a cyanide tip, the police chief added.
“The mere fact that he used a high-powered gun and poisoned tip bullet is a manifestation that the suspect intends to kill and not to defend himself,” Dayco told reporters.
Lawmen tracked down Querubin at the St. Luke’s Hospital in Quezon City after the judge reportedly changed hospitals thrice to evade police. He is now under guard while receiving treatment at the said hospital.

"The said charges stemmed from the death of Gerardo Martinez on the evening of Nov. 22 near the Ynares Sports Center in Bgy. San Roque, Antipolo City.
According to the police report, Martinez and his girlfriend was riding a motorcycle along Ortigas Ext. near Beverly Hills Subd. around 9:30 p.m. Friday when a Ford Lynx cut in front of them.
The report said Martinez angrily chased the car, which the judge was driving. Both vehicles stopped upon reaching a deep ravine a few meters away from the Ynares Sports Center.
Witnesses told police that Martinez started banging on the hood of the car while challenging the driver to come out.
Police said the judge tried to drive away but was prevented from doing so because of the heavy traffic in the area.
According to the police report, Martinez hit Querubin with metal knuckles. The judge then pulled out a revolver and shot Martinez once in the abdomen. Despite being hit, Martinez lunged at the judge and hit him on the face. Both men grappled for the revolver but bystanders intervened and brought the wounded Martinez to the Unciano General Hospital where he was declared dead on arrival. The judge, who suffered several cuts on his face, was also brought for treatment at the same hospital."
